Class Action Waiver: YOU AND ABC AI LAB LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a class or representative proceeding.
Waiver of Jury Trial: BY AGREEING TO THESE TERMS, YOU AND ABC AI LAB LLC EACH WAIVE THE RIGHT TO A JURY TRIAL.
Small Claims Exception: Notwithstanding the foregoing, either party may bring an individual action in small claims court in the State of Florida.
These Terms and any disputes arising hereunder shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles. To the extent that arbitration does not apply, you consent to the exclusive jurisdiction of the state and federal courts located in the State of Florida.
ABC AI Lab LLC shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, government orders, wars, terrorism, riots, embargoes, acts of civil or military authorities, fires, floods, accidents, strikes, shortages of transportation, fuel, energy, labor, or materials.
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the remaining provisions, which shall continue in full force and effect.
These Terms, together with our Privacy Policy, Return & Refund Policy, and Shipping Policy, constitute the entire agreement between you and ABC AI Lab LLC regarding your use of the Site and supersede all prior agreements, representations, and understandings.
We reserve the right to modify, amend, or update these Terms at any time at our sole discretion. Changes will be effective immediately upon posting to the Site.
